Welcome to the website of Maven Peak Solutions. These Terms of Service govern your access to and use of our digital platforms, the Blueprint Hub (containing app clones), technical consulting, custom development services, and operational modules. By accessing this site, placing an order, requesting an estimate, or executing a service kickoff, you agree to comply with and be bound by the following terms.
01/ Services and the Blueprint Hub
Maven Peak Solutions operates both as a pre-engineered product solutions vendor and a custom software engineering agency.
- App Clones / Blueprints: Ready-to-build frameworks designed to accelerate product launch timelines. These are starting foundations (not final plug-and-play white-label frameworks) and require configuration of APIs, branding assets, and database endpoints to become fully operational.
- Custom Development: Software built from the ground up tailored to unique organizational workflows, custom scaling requirements, and integration patterns.
- Technical Consultancy: Free and premium scoping sessions, system documentation, and architecture design consultation.
02/ Client Onboarding and Project Kickoff
To ensure high efficiency and guarantee quality standards, we enforce the following kickoff policies:
- 72-Hour Project Kickoff: Upon contract execution and cleared milestone invoice, project development sprints initiate within 72 business hours.
- Requirement Finalization: The client must provide all technical prerequisites, branding elements, and copy assets within agreed-upon timelines. Delays in asset provision will cause shift adjustments in delivery targets.
03/ Financial Commitments, Invoicing, and Milestone Payments
Projects are cleared via custom milestones or subscription SLA models:
- Milestone Billing: Work is segmented into specific billing sprints (e.g. 30% kickoff, 40% beta demonstration, 30% production handover). Milestones are detailed in the specific statement of work (SOW).
- Due Dates: Invoices are payable upon receipt. Work sprints are paused if milestones remain outstanding for more than 5 business days past the due date.
- Refund Exclusions: Payments made for started milestones or pre-engineered clone source-code packages are non-refundable due to the digital nature of code delivery.
04/ Intellectual Property, Handover, and Code Ownership
We guarantee clear code ownership rights to protect your digital assets:
- 100% Code Handover: Upon full and final settlement of all invoices, the complete custom source code is handed over to you. There are no recurring licensing, royalty, or vendor lock-in fees for standard delivery.
- Open Source & Libraries: Maven Peak Solutions retains copyright over its pre-engineered base blueprints. You are granted an unlimited, perpetual, royalty-free, non-exclusive license to use, modify, and distribute the code compiled for your business.
- Client Warranties: The client guarantees that any graphics, copy, or technical systems provided to Maven Peak Solutions do not infringe upon any third-party trademark or intellectual property rights.
05/ Post-Launch support and SLA Maintenance
Our quality assurance continues after code deployment:
- 30-Day Bug-Free Warranty: All custom code delivered includes a 30-day post-launch warranty, during which bugs matching contract specifications are resolved at zero cost.
- SLA Packages: Extended security upgrades, continuous system uptime tracking, scaling upgrades, and active dev-ops support require a monthly SLA (Service Level Agreement) maintenance plan.
06/ Third-Party Integrations and API Disclaimers
Modern applications frequently interact with external web APIs (payment portals like Stripe, SMS gateways like Twilio, Maps APIs, etc.).
Maven Peak Solutions is not responsible for any alterations, billing hikes, rate limiting, or service terminations occurring within external third-party tools or platforms integrated into your system. Payment configurations, API subscription management, and compliance with external developer terms remain the sole responsibility of the client.
07/ Limitation of Liability and Indemnification
To the maximum extent permitted by applicable laws, Maven Peak Solutions' cumulative liability for all claims arising from website use, custom deliverables, or blueprints shall not exceed the total amount paid by the client under the corresponding contract. We are not liable for indirect, incidental, or punitive damages, including loss of business profits, data corruption, or system downtime.
08/ Dispute Resolution and Governing Law
These Terms of Service shall be governed by, construed, and enforced in accordance with the laws of the jurisdiction where Maven Peak Solutions' principal operations are located, without regard to conflicts of law provisions. Any legal disputes arising from our services shall be settled via binding arbitration before courts of competent jurisdiction.
